用户协议 / User Agreement

引言 / Preamble

本《用户协议》（以下简称 “本协议”）由 Carry AI 平台（以下简称 “平台” 或 “我们”）制定。通过注册、登录或使用平台服务，用户（以下简称 “您”）即视为已接受本协议的所有条款。为了保护您的权益，请在使用前仔细阅读本协议。如果您不同意这些条款，请不要使用我们的服务。

This User Agreement (hereinafter referred to as "this Agreement") is formulated by Carry AI Platform (hereinafter referred to as "the Platform" or "we"). By registering, logging in, or using the Platform's services, the user (hereinafter referred to as "you") is deemed to have accepted all terms of this Agreement. To protect your rights and interests, please read this Agreement carefully before use. If you do not agree to these terms, please do not use our services.

1. 平台服务 / Platform Services

1.1 服务内容 / Service Content

本平台通过网站（https://carryai.ai/）向用户提供以下人工智能技术服务，所有功能均通过网站界面操作完成：

The Platform provides the following artificial intelligence technology services to users through its website (https://carryai.ai/), with all functions operated via the website interface:

• 服务浏览功能：用户可通过网站页面浏览平台当前提供的大模型 API 调用服务类型，具体包括：
  Service Browsing Function: Users can browse the types of large model API calling services currently provided by the Platform through website pages, including:
  • 图生视频：通过 API 接口，根据用户上传的图片素材生成一段短视频。
  • Text-to-Video: Generate a short video based on user-uploaded image materials via the API interface.

用户需在消费前仔细查看服务详情（如生成视频的预估时长范围、分辨率、单价等），平台展示内容为服务有效性及范围的唯一依据。

Users must carefully review service details (such as estimated video duration range, resolution, unit price) before consumption. The content displayed on the Platform is the sole basis for the validity and scope of services.

• API 调用功能：用户通过平台提供的 API 接口提交图片及参数（如视频时长），发起视频生成请求。
  API Calling Function: Users submit images and parameters (e.g., video duration) through the API interface provided by the Platform to initiate video generation requests.
• 支付功能：平台采用 “先充值后消费” 模式：用户需先通过平台支持的支付渠道将款项充值至平台账户余额；API 调用成功后，直接从账户余额扣除对应金额完成支付。
  Payment Function: The Platform adopts a "pre-recharge, post-consumption" model: Users must first recharge funds to their Platform account balance through supported payment channels; after successful API calling, the corresponding amount is directly deducted from the account balance to complete payment.
• 订单管理功能：用户可在网站内实时查看 API 调用记录（即订单）状态，包括：调用请求已提交、生成中、生成成功 / 失败、扣款完成。
  Order Management Function: Users can real-time check the status of API calling records (i.e., orders) on the website, including: call request submitted, generating, generation successful/failed, and payment completed.

1.2 服务性质 / Service Nature

• 技术提供性质：平台是图生视频技术服务的提供主体，通过自研或整合的大模型能力向用户交付服务。
  Technology Provision Nature: The Platform is the main provider of Text-to-Video technical services, delivering services to users through self-developed or integrated large model capabilities.
• 内容限制：用户需保证上传的图片内容合法合规。平台禁止用户上传、传播任何违反法律法规或侵犯他人权益的内容。生成视频的版权归属依照本协议第 5 条执行。
  Content Restrictions: Users must ensure that uploaded image content is legal and compliant. The Platform prohibits users from uploading or disseminating any content that violates laws and regulations or infringes upon the rights and interests of others. The ownership of generated videos shall be governed by Article 5 of this Agreement.
• 更新与维护权：平台保留单方面调整服务参数（如支持生成的视频时长、清晰度）、升级系统功能或终止部分 / 全部服务的权利。
  Right to Update and Maintain: The Platform reserves the right to unilaterally adjust service parameters (e.g., supported video duration, clarity), upgrade system functions, or terminate part or all of the services.
• 技术免责声明：您理解并同意，基于大模型的技术特性，本服务生成的内容可能存在不准确、不连贯、不符合预期或出现 “幻觉”（即生成内容与输入图片或现实物理规律存在较大偏差）的情况。这属于技术的固有局限性，平台不就此承担任何责任。
  Technical Disclaimer: You understand and agree that due to the technical characteristics of large models, the content generated by this service may be inaccurate, inconsistent, inconsistent with expectations, or exhibit "hallucinations" (i.e., significant deviations between generated content and input images or real physical laws). This is an inherent limitation of the technology, and the Platform shall not be liable for any such issues.

2. 服务范围 / Service Scope

2.1 地理范围 / Geographic Scope

平台的服务通过全球互联网提供，理论上用户在任何具备互联网接入条件的地区均可尝试访问本平台网站（https://carryai.ai/）并使用服务。然而，您理解并同意，服务的实际可用性和质量受以下因素制约，平台对此不作任何确定性保证：

The Platform's services are provided via the global Internet. In theory, users can attempt to access the Platform's website (https://carryai.ai/) and use the services from any region with Internet access. However, you understand and agree that the actual availability and quality of services are subject to the following factors, and the Platform makes no definite guarantees thereof:

• 网络环境因素：服务的顺畅使用取决于您本地的网络服务提供商（ISP）的质量、带宽以及稳定性。跨地区、跨国界的网络连接可能存在延迟、丢包或中断现象，这属于互联网服务的固有特性，平台无法直接控制。
  Network Environment Factors: The smooth use of services depends on the quality, bandwidth, and stability of your local Internet Service Provider (ISP). Cross-regional or cross-border network connections may experience delays, packet loss, or interruptions, which are inherent characteristics of Internet services that the Platform cannot directly control.
• 法律法规因素：您所在的国家或地区可能对互联网服务、数据跨境传输或人工智能技术应用有特定的法律法规或行政管制。您有责任确保您在当地使用本服务是合法的。若因您所在地的法律限制导致无法使用服务或产生任何法律风险，由您自行承担全部责任。
  Legal and Regulatory Factors: The country or region where you are located may have specific laws, regulations, or administrative controls on Internet services, cross-border data transmission, or the application of artificial intelligence technology. You are responsible for ensuring that your use of this service is legal locally. If you are unable to use the service or incur any legal risks due to legal restrictions in your location, you shall bear full responsibility.
• 技术访问障碍：部分国家或地区可能对特定的网络服务或 IP 地址段采取限制措施（如防火墙、网络封锁），这可能导致您无法正常访问我们的服务平台。
  Technical Access Barriers: Some countries or regions may impose restrictive measures (such as firewalls, network blockades) on specific network services or IP address ranges, which may prevent you from accessing our service platform normally.

2.2 服务时间 / Service Hours

• 全年服务基础功能：平台的核心功能提供全年 24 小时无间断服务，无固定休息日。
  24/7 Basic Services: The Platform's core functions provide uninterrupted 24/7 services with no fixed rest days.
• 例外条款：因系统维护、技术升级或不可抗力导致的临时中断除外。
  Exception Clauses: Excluding temporary interruptions caused by system maintenance, technical upgrades, or force majeure.
• 临时中断处理：
  Handling of Temporary Interruptions:
  • 计划性中断（如系统维护、版本升级）：平台需提前至少 24 小时在公告栏发布通知，用户需自行查阅。
    Planned Interruptions (e.g., system maintenance, version upgrades): The Platform shall issue a notice on the announcement board at least 24 hours in advance, and users shall check it independently.
  • 不可抗力中断（如自然灾害、政府紧急管制、大规模网络瘫痪、战争）：平台不承担由此引发的服务中断责任或用户损失赔偿；平台承诺在不可抗力事件消除后，优先恢复服务并通过公告或站内消息通知用户。
    Force Majeure Interruptions (e.g., natural disasters, government emergency controls, large-scale network outages, wars): The Platform shall not be liable for service interruptions or user losses arising therefrom; the Platform undertakes to prioritize service restoration and notify users via announcements or in-site messages after the force majeure event is eliminated.

2.3 特殊说明 / Special Notes

• 调整权利保留：平台保留随时单方面调整服务范围（如新增 / 暂停特定地区服务）或服务时间的权利。
  Right to Adjust Reserved: The Platform reserves the right to unilaterally adjust the service scope (e.g., add/suspend services in specific regions) or service hours at any time.
• 用户义务：所有调整内容均在平台公告栏（小程序首页或指定页面）发布，用户有义务主动定期查阅公告；平台不另行通过短信、电话等方式单独通知用户。
  User Obligations: All adjustments shall be published on the Platform's announcement board (mini-program homepage or designated page), and users are obligated to actively check the announcements regularly; the Platform will not separately notify users via SMS, phone calls, or other means.

3. 角色区分 / Role Differentiation

3.1 用户角色与责任 / User Roles and Responsibilities

• 定义与资格：用户是指通过平台认可的方式（如邮箱注册、第三方授权登录）完成注册程序，并接受本协议条款的个人。
  Definition and Qualifications: A user refers to an individual who completes the registration process through methods recognized by the Platform (e.g., email registration, third-party authorized login) and accepts the terms of this Agreement.
• 用户必须是年满 18 周岁、具备完全民事行为能力的自然人。机构或个人若代表企业等组织注册，则需保证其已获得该组织的充分授权。
  Users must be natural persons over 18 years of age with full capacity for civil conduct. If an institution or individual registers on behalf of an organization such as an enterprise, they must ensure they have obtained sufficient authorization from the organization.
• 严格年龄限制与未成年人保护：
  Strict Age Restrictions and Minor Protection:
  • 绝对禁止：平台明确禁止未满 18 周岁的未成年人（以下简称 “未成年人”）以任何形式注册账户或使用任何服务。平台将年龄合规作为服务使用的首要前提。
    Absolute Prohibition: The Platform explicitly prohibits minors under 18 years of age (hereinafter referred to as "minors") from registering accounts or using any services in any form. Age compliance is the primary prerequisite for using the services.
  • 监管措施：平台将通过技术手段（如结合实名信息核验）及人工审核等方式，尽合理努力识别未成年人用户。一旦发现或合理怀疑用户为未成年人，平台有权立即单方面暂停或永久冻结该账户，并终止提供服务，且不因此承担任何责任。
    Regulatory Measures: The Platform will make reasonable efforts to identify minor users through technical means (e.g., combining real-name information verification) and manual review. Once a user is found or reasonably suspected to be a minor, the Platform has the right to immediately suspend or permanently freeze the account unilaterally, terminate the provision of services, and shall not be liable for any consequences thereof.
  • 监护人责任：若未成年人通过冒用监护人信息、使用他人账户或其他方式规避年龄限制使用本服务，其法定监护人应承担由此导致的一切法律后果和经济损失，包括但不限于已产生的充值消费、因使用服务引发的第三方索赔、以及因未成年人违规行为给平台造成的损失。平台在此情况下不承担任何退款或赔偿义务，并保留向监护人追偿的权利。
    Guardian's Responsibility: If a minor uses this service by misappropriating guardian's information, using another person's account, or other means to circumvent age restrictions, their legal guardian shall bear all legal consequences and economic losses arising therefrom, including but not limited to generated recharge consumption, third-party claims arising from service use, and losses caused to the Platform by the minor's illegal acts. In such cases, the Platform shall not assume any refund or compensation obligations and reserves the right to claim compensation from the guardian.
• 账户安全保管义务：您应妥善保管用于访问和使用本服务的各类凭证，包括但不限于账户密码、API Key、Token 等。您应对通过您账户及 API Key 进行的所有操作和活动负全部责任。任何因您未能妥善保管上述凭证（包括但不限于泄露、出借、转让）而导致的任何损失、费用或责任，均由您自行承担。平台在技术层面通过 API Key 识别请求来源并据此计费，凡使用您的 API Key 发起的请求均视为您本人或您授权下的行为。
  Obligation to Keep Account Secure: You shall properly keep all credentials used to access and use this service, including but not limited to account passwords, API Keys, Tokens, etc. You shall be fully responsible for all operations and activities conducted through your account and API Key. Any losses, expenses, or liabilities arising from your failure to properly keep the above credentials (including but not limited to disclosure, lending, transfer) shall be borne by you alone. The Platform identifies the source of requests and bills accordingly through API Keys at the technical level; all requests initiated using your API Key are deemed to be actions by you or authorized by you.
• 用户核心责任：
  User's Core Responsibilities:
  • 信息真实性：用户有义务提供真实、准确、完整及最新的注册信息，并及时进行更新。因用户提供虚假、过期或非法信息（如无效联系方式、未实名认证、盗用他人信息）导致的一切后果，包括但不限于账户异常、服务受限、无法享受售后服务等，均由用户自行承担。
    Authenticity of Information: Users are obligated to provide true, accurate, complete, and up-to-date registration information and update it in a timely manner. All consequences arising from users providing false, outdated, or illegal information (e.g., invalid contact information, failure to complete real-name authentication, misappropriation of others' information), including but not limited to account abnormalities, service restrictions, and inability to enjoy after-sales services, shall be borne by users alone.
  • 行为合规性：用户应独立对其账户下的一切行为负责，确保使用服务的行为符合本协议约定及相关法律法规。用户不得利用服务从事任何违法违规或侵害他人权益的活动（具体见 “使用规范” 章节）。因用户不当行为（如上传违规图片、利用生成内容进行欺诈、攻击系统等）给平台或任何第三方造成的损失，用户需依法承担全部赔偿责任。
    Compliance of Conduct: Users shall independently be responsible for all actions under their accounts and ensure that the use of services complies with the provisions of this Agreement and relevant laws and regulations. Users shall not use the services to engage in any illegal or irregular activities that infringe upon the rights and interests of others (see the "Usage Norms" chapter for details). Users shall legally bear full compensation liability for losses caused to the Platform or any third party due to their improper conduct (e.g., uploading illegal images, using generated content for fraud, attacking systems).

3.2 平台角色与责任 / Platform Roles and Responsibilities

• 定义与定位：平台是 “图生视频” API 技术服务的唯一运营方和提供主体，负责维护服务的技术架构、运营网站、处理订单及提供客户支持。
  Definition and Positioning: The Platform is the sole operator and provider of the "Image-to-Video" API technical services, responsible for maintaining the technical architecture of the services, operating the website, processing orders, and providing customer support.
• 平台核心职责：
  Platform's Core Responsibilities:
  • 服务提供与维护：平台承诺尽商业上的合理努力确保服务的稳定性和安全性，按服务描述向合规用户提供技术能力。
    Service Provision and Maintenance: The Platform undertakes to make commercially reasonable efforts to ensure the stability and security of services and provide technical capabilities to compliant users in accordance with service descriptions.
  • 信息透明：平台有责任在其官方网站上明确公示服务的功能、价格、使用规则及本协议条款，并在变更时及时通知用户。
    Information Transparency: The Platform is obligated to clearly disclose service functions, prices, usage rules, and terms of this Agreement on its official website and notify users in a timely manner of any changes.
  • 争议处理：平台设立客户支持渠道，在约定的服务时间内，负责处理与订单履行、API 调用失败、支付错误等直接相关的用户争议。
    Dispute Resolution: The Platform establishes customer support channels to handle user disputes directly related to order fulfillment, API calling failures, payment errors, etc., during the agreed service hours.
• 平台责任限制与免责声明：
  Platform's Liability Limitations and Disclaimers:
  • 技术输出免责：如本协议其他章节所述，平台作为技术服务提供方，不对 AI 生成内容的准确性、质量、适用性及合法性作任何明示或默示的保证。用户应对生成内容进行审慎评估，并独立承担使用该内容的一切风险。
    Technical Output Disclaimer: As stated in other chapters of this Agreement, as a technical service provider, the Platform makes no express or implied guarantees regarding the accuracy, quality, applicability, or legality of AI-generated content. Users shall carefully evaluate the generated content and independently bear all risks associated with its use.
  • 用户行为免责：平台不承担因用户个人操作失误（如错误设置生成参数、误充值）、对服务功能的误解或违反本协议及法律的行为所导致的任何直接或间接损失。
    User Conduct Disclaimer: The Platform shall not be liable for any direct or indirect losses caused by users' personal operational errors (e.g., incorrect setting of generation parameters, mistaken recharge), misunderstandings of service functions, or violations of this Agreement and laws.
  • 未成年人使用免责：平台对未成年人使用的预防和监管责任限于采取合理的技术和管理措施。实际的、首要的监护责任由其法定监护人履行，平台无法完全替代或保证杜绝此类情况的发生。
    Minor Use Disclaimer: The Platform's liability for the prevention and supervision of minor use is limited to the adoption of reasonable technical and management measures. The actual primary guardianship responsibility shall be performed by their legal guardians, and the Platform cannot fully replace or guarantee the prevention of such situations.
  • 不可抗力免责：因不可抗力、第三方服务故障（如网络服务商、支付渠道）等原因导致的服务中断或数据丢失，平台不承担责任，但将尽力减少由此产生的影响。
    Force Majeure Disclaimer: The Platform shall not be liable for service interruptions or data loss caused by force majeure, third-party service failures (e.g., network service providers, payment channels), etc., but will strive to minimize the impact thereof.

3.3 双方关系界定 / Bilateral Relationship

• 法律关系：用户与平台之间就服务的使用所形成的法律关系是技术服务合同关系，受《中华人民共和国民法典》等相关法律法规约束。本协议即为该合同的核心组成部分。平台并非用户的代理人、合伙人或雇员。
  Legal Relationship: The legal relationship formed between users and the Platform regarding the use of services is a technical service contract relationship, governed by the Civil Code of the People's Republic of China and other relevant laws and regulations. This Agreement is the core component of such a contract. The Platform is not the agent, partner, or employee of the user.
• 管理权限：为维护服务秩序和社区准则，平台有权单方面对用户行为进行监督，并对违反本协议的行为采取相应的管理措施（如警告、限制功能、冻结账户等）。用户同意接受平台基于合理判断作出的管理决定。
  Management Authority: To maintain service order and community guidelines, the Platform has the right to unilaterally supervise user conduct and take corresponding management measures (e.g., warnings, function restrictions, account freezing) against violations of this Agreement. Users agree to accept management decisions made by the Platform based on reasonable judgment.
• 义务确认：用户认可，定期查阅平台公告、邮件等官方渠道发布的通知是其义务，不得以未收到通知为由主张平台程序无效或要求豁免责任。
  Obligation Confirmation: Users acknowledge that it is their obligation to regularly check notifications published through official channels such as Platform announcements and emails, and shall not claim the invalidity of Platform procedures or request exemption from liability on the grounds of not receiving notifications.

4. 使用规范 / Usage Norms

4.1 行为要求 / Conduct Requirements

用户在使用本平台服务时，必须严格遵守中华人民共和国现行有效的法律法规、规章条例、司法解释以及本协议的全部约定。任何用户不得利用本服务从事任何违法、违规或侵害他人合法权益的行为。

When using the Platform's services, users must strictly comply with the currently effective laws, regulations, rules, judicial interpretations of the People's Republic of China, and all provisions of this Agreement. No user may use the services to engage in any illegal, irregular, or activities that infringe upon the legitimate rights and interests of others.

4.2 禁止行为清单 / Prohibited Conduct

• 危害国家安全与公共安全：制作、上传、传播或利用生成内容散布任何反对宪法确定的基本原则、危害国家安全、泄露国家秘密、颠覆国家政权、破坏国家统一、损害国家荣誉和利益、煽动民族仇恨、民族歧视、破坏民族团结、破坏国家宗教政策、宣扬邪教和封建迷信的内容。
  Endangering National Security and Public Safety: Produce, upload, disseminate, or use generated content to spread any content that opposes the fundamental principles established by the Constitution, endangers national security, discloses state secrets, subverts state power, undermines national unity, damages national honor and interests, incites ethnic hatred, ethnic discrimination, undermines ethnic unity, violates national religious policies, or promotes cults and feudal superstition.
• 传播淫秽色情与低俗信息：利用本服务制作、复制、发布、传播任何淫秽、色情内容，包括但不限于露骨的色情描述、性暗示信息、成人娱乐内容，或任何其他含有色情、低俗意味的图片及生成视频。
  Disseminating Obscene, Pornographic, and Vulgar Information: Use the services to produce, copy, publish, or disseminate any obscene or pornographic content, including but not limited to explicit pornographic descriptions, sexually suggestive information, adult entertainment content, or any other images and generated videos with pornographic or vulgar implications.
• 宣扬暴力与恐怖主义：制作、上传、传播或利用生成内容宣扬暴力、恐怖主义、极端主义、血腥场景，或教唆他人实施犯罪行为（如自杀、自残、吸毒、赌博、爆炸物制作等）。
  Promoting Violence and Terrorism: Produce, upload, disseminate, or use generated content to promote violence, terrorism, extremism, bloody scenes, or incite others to commit criminal acts (e.g., suicide, self-harm, drug use, gambling, explosive manufacturing).
• 侵犯他人合法权益：
  Infringing Upon Others' Legitimate Rights and Interests:
  • 知识产权：未经授权，上传或生成任何侵犯他人著作权、商标权、专利权、商业秘密等知识产权的内容。
    Intellectual Property Rights: Upload or generate any content that infringes upon others' intellectual property rights such as copyrights, trademarks, patents, or trade secrets without authorization.
  • 肖像权与隐私权：未经同意，上传或生成包含他人肖像、隐私信息（如身份证号、住址、联系方式）的内容，或进行诽谤、侮辱、诋毁他人商誉。
    Portrait Rights and Privacy Rights: Upload or generate content containing others' portraits or privacy information (e.g., ID numbers, addresses, contact information) without consent, or defame, insult, or discredit others' business reputation.
• 欺诈与虚假宣传：利用生成内容进行任何形式的欺诈、虚假宣传、误导消费者，或用于非法集资、传销等违法犯罪活动。
  Fraud and False Advertising: Use generated content for any form of fraud, false advertising, misleading consumers, or illegal and criminal activities such as illegal fund-raising or pyramid schemes.
• 破坏系统安全与秩序：
  Undermining System Security and Order:
  • 禁止任何形式的网络攻击，如入侵系统、恶意爬取数据、传播病毒木马、发起 DDoS 攻击等。
    Prohibit any form of cyber attacks, such as system intrusion, malicious data crawling, spreading viruses or Trojans, or launching DDoS attacks.
  • 禁止利用技术漏洞进行非法充值、篡改订单、套取服务等行为。
    Prohibit using technical vulnerabilities for illegal recharging, order tampering, obtaining services improperly, etc.
  • 禁止进行任何干扰或破坏平台服务正常运行的行为，如发送垃圾请求、滥用 API 接口等。
    Prohibit any conduct that interferes with or undermines the normal operation of the Platform's services, such as sending spam requests or abusing API interfaces.
• 不正当商业行为：禁止进行刷单、套现、虚假交易等破坏平台公平交易秩序的行为。
  Unfair Commercial Conduct: Prohibit conduct that undermines the Platform's fair transaction order, such as brushing orders, cash-out, or fake transactions.
• 违反安全规范，因自身重大过失导致 API Key 等敏感凭证泄露，并对平台系统安全或其他用户利益构成潜在风险的行为。
  Violating Security Norms: Conduct that causes the leakage of sensitive credentials such as API Keys due to one's own gross negligence and poses potential risks to the Platform's system security or the interests of other users.

4.3 违约责任与处理措施 / Breach and Handling

一旦平台发现或合理相信用户存在任何上述禁止行为，平台有权根据违规情节的严重程度，独立判断并采取以下一项或多项处理措施，而无需承担任何责任：

Once the Platform discovers or reasonably believes that a user has engaged in any of the above prohibited conduct, the Platform has the right to independently judge and take one or more of the following handling measures based on the severity of the violation, without assuming any liability:

• 警告 / Warning
• 限制或暂停部分服务功能 / Restrict or suspend partial service functions
• 冻结账户 / Freeze account
• 永久封禁（终止服务） / Permanent ban (terminate services)
• 追究法律责任 / Pursue legal liability

4.4 处理流程与用户权利 / Process and User Rights

• 通知：平台在采取处理措施（尤其是限制功能、冻结或封禁账户时）将通过用户注册的联系方式或其他可行途径通知用户，说明违规事实、处理依据及处理措施。
  Notification: When taking handling measures (especially function restrictions, account freezing, or banning), the Platform will notify the user through the registered contact information or other feasible means, explaining the violation facts, basis for handling, and handling measures.
• 申诉：用户如对处理决定有异议，可在收到通知之日起 7 个工作日内，通过平台官方公布的客服渠道提交书面申诉及相关证明材料。平台将在收到申诉后 15 个工作日内进行复核并给予答复。复核期间不影响已采取处理措施的执行。
  Appeal: If the user disagrees with the handling decision, they may submit a written appeal and relevant supporting materials through the official customer service channel announced by the Platform within 7 working days from the date of receiving the notification. The Platform will review and respond within 15 working days after receiving the appeal. The implementation of the adopted handling measures will not be affected during the review period.

5. 知识产权 / Intellectual Property Rights

5.1 平台知识产权 / Platform IP

平台独立拥有或经合法授权获得了本服务及相关技术、信息内容的全部知识产权。此部分知识产权作为平台的核心资产，受法律法规保护，未经平台明确书面授权，任何用户或个人均不得以任何方式直接或间接地使用、修改、复制、传播、创造衍生作品或进行反向工程。这些资产明确包括但不限于：

The Platform independently owns or legally authorizes all intellectual property rights of this service and related technologies and information content. These intellectual property rights, as the core assets of the Platform, are protected by laws and regulations. Without the Platform's explicit written authorization, no user or individual may directly or indirectly use, modify, copy, disseminate, create derivative works, or conduct reverse engineering in any way. These assets specifically include but are not limited to:

• 技术成果：本服务所依托的网站（https://carryai.ai/）、应用程序编程接口（API）、底层源代码、目标代码、算法、模型、数据库、技术文档等。
  Technical Achievements: The website on which this service is based (https://carryai.ai/), Application Programming Interfaces (APIs), underlying source code, object code, algorithms, models, databases, technical documents, etc.
• 品牌与形象：平台的名称、商标、标识（Logo）、图形用户界面（GUI）、视觉设计、以及任何其他商业标识。
  Brand and Image: The Platform's name, trademarks, logos, Graphical User Interfaces (GUIs), visual designs, and any other commercial identifiers.
• 信息内容：平台自行制作、发布在网站上的所有非用户生成的内容，如服务描述、软件、图片、音频、视频等。
  Information Content: All non-user-generated content produced and published on the website by the Platform, such as service descriptions, software, images, audio, videos, etc.

5.2 生成内容归属与授权 / Generated Content Ownership

• 用户权利：您理解并同意，您独立上传的原始图片以及您通过调用本服务 API 生成的视频内容（以下合称 “生成内容”），其相关知识产权的归属与行使，由您依据《中华人民共和国著作权法》等相关法律享有并承担责任。平台明确不对该等生成内容主张任何所有权。
  User Rights: You understand and agree that you shall enjoy and bear responsibility for the relevant intellectual property rights of the original images you independently upload and the video content generated by calling the Platform's service API (hereinafter collectively referred to as "generated content") in accordance with the Copyright Law of the People's Republic of China and other relevant laws. The Platform explicitly does not claim any ownership of such generated content.
• 用户保证与责任：您特此声明并保证，您上传的图片拥有合法的来源，并获得了必要的授权，不侵犯任何第三方的知识产权、肖像权、隐私权等合法权益。您应对生成内容的后续使用（包括但不限于复制、修改、发行、公开表演）承担全部法律责任。如因生成内容导致任何第三方提出权利主张或投诉，您应自行解决并承担由此给平台造成的全部损失。
  User Guarantees and Liabilities: You hereby represent and warrant that the images you upload have a legal source and have obtained necessary authorizations, and do not infringe upon any third party's intellectual property rights, portrait rights, privacy rights, or other legitimate rights and interests. You shall bear full legal responsibility for the subsequent use of the generated content (including but not limited to reproduction, modification, distribution, and public performance). If any third party makes a claim or complaint due to the generated content, you shall resolve it independently and bear all losses caused to the Platform thereby.
• 平台的使用授权：为向您提供并持续优化服务之目的，您在此授予平台一项全球范围内、免许可费的有限许可，允许平台在服务所必需的期限内，存储、缓存、处理您上传的图片和生成的视频。此项许可仅限于平台内部运行和技术维护所需，不代表平台有权在服务目的之外对您的生成内容进行商业性的复制、发行或公开展示。
  Platform's Usage Authorization: For the purpose of providing and continuously optimizing the services to you, you hereby grant the Platform a global, royalty-free limited license to store, cache, and process the images you upload and the generated videos for the period necessary for the services. This license is limited to the Platform's internal operations and technical maintenance needs and does not mean the Platform has the right to commercially reproduce, distribute, or publicly display your generated content beyond the purpose of the services.

6. 订单与支付 / Orders and Payments

6.1 支付方式与计费规则 / Payment Methods and Billing

• 预充值模式：您在使用本服务的 API 调用功能前，必须通过平台指定的支付渠道（如Stripe、支付宝等）预先充值至您在本平台的账户余额中。您的账户余额是您调用 API 服务并进行支付结算的唯一依据。
  Pre-Recharge Model: Before using the API calling function of this service, you must pre-recharge funds to your account balance on the Platform through the designated payment channels (e.g., Stripe, Alipay). Your account balance is the sole basis for you to call API services and settle payments.
• 计费标准：本服务采用按次调用计费的模式。具体计费规则为按生成视频的秒数进行阶梯计价。具体的价格档位、计费标准及任何变更，均以平台网站实时公示的信息为准。
  Billing Standards: This service adopts a per-call billing model. The specific billing rule is tiered pricing based on the duration of the generated video. The specific price tiers, billing standards, and any changes thereof shall be subject to the real-time information displayed on the Platform's website.
• 用户核对义务：您在每次发起 API 调用请求前，有义务仔细核对所有输入参数（包括但不限于生成视频的预期时长、分辨率等）以及此次调用将产生的费用。一旦您确认并提交调用请求，即视为您同意按公示价格支付相应费用。因您自身操作失误（如参数设置错误、误操作发起调用）导致的一切损失，包括但不限于产生不必要的费用、生成不符合预期的内容等，均由您自行承担，平台不予退款或补偿。
  User's Obligation to Verify: Before initiating each API call request, you are obligated to carefully verify all input parameters (including but not limited to the expected duration and resolution of the generated video) and the fees to be incurred for this call. Once you confirm and submit the call request, you are deemed to agree to pay the corresponding fees at the displayed price. All losses caused by your own operational errors (e.g., incorrect parameter settings, mistaken initiation of calls), including but not limited to unnecessary fees incurred and generated content that does not meet expectations, shall be borne by you alone, and the Platform will not provide refunds or compensation.
• API Key 泄漏责任：您理解并同意，API Key 是您调用服务并进行计费的唯一身份凭证。任何通过您 API Key 发起的 API 调用所产生的费用，无论是否为您本人或您授权之人操作，均计入您的账户消费。因您保管不善（包括但不限于在客户端代码中硬编码密钥、将密钥泄露至公开仓库、被第三方恶意软件窃取等）导致 API Key 泄漏并由此产生的一切费用及后果，均由您自行承担，平台不承担任何退款或赔偿义务。
  Liability for API Key Leakage: You understand and agree that the API Key is the sole identity credential for you to call the service and settle fees. All fees incurred by API calls initiated through your API Key, whether operated by you or authorized by you, shall be credited to your account consumption. Any fees and consequences arising from the leakage of the API Key due to improper storage by you (including but not limited to hardcoding the key in client-side code, disclosing the key to public repositories, or being stolen by third-party malware) shall be borne by you alone, and the Platform will not assume any refund or compensation obligations.

6.2 退款政策与流程 / Refund Policy and Process

    Refundable Scenarios: Limited to cases where API call requests completely fail (i.e., no video files are generated) due to Platform-controllable technical failures, system errors, or other Platform-related reasons. Users must provide corresponding call failure records or error codes for verification.
  • 不可退款情形：对于所有已成功发起并完成的 API 调用（即系统已开始处理并返回了生成结果，无论生成内容的质量、观感或是否符合您的主观预期），平台原则上不予退款。这包括但不限于：您对生成视频内容不满意、生成内容存在 AI 技术固有的瑕疵（如 “幻觉”、不连贯）、以及因您参数设置不当导致的内容不符等。
    Non-Refundable Scenarios: The Platform generally does not provide refunds for all API calls that have been successfully initiated and completed (i.e., the system has started processing and returned generation results, regardless of the quality, appearance, or whether the generated content meets your subjective expectations). This includes but is not limited to: dissatisfaction with the generated video content, inherent flaws of AI technology in the generated content (e.g., "hallucinations," inconsistency), and content inconsistency caused by improper parameter settings by you.

  • 申请：符合条件的用户需在调用失败后 7 个工作日内，通过平台提供的客服渠道提交书面退款申请，并说明具体情况。
    Application: Eligible users must submit a written refund application through the customer service channel provided by the Platform within 7 working days after the call failure, explaining the specific situation.
  • 审核：平台将在收到申请后 1-3 个工作日内进行审核。平台有权要求用户提供必要信息以核实退款资格，并拥有最终的审核决定权。
    Review: The Platform will review within 1-3 working days after receiving the application. The Platform has the right to request users to provide necessary information to verify refund eligibility and has the final decision-making power on the review.
  • 执行：审核通过后，平台将把退款金额原路退回至您的原支付账户（如微信零钱、银行卡），或经您同意后退回至您的平台账户余额中以供下次使用。退款到账时间将根据不同支付渠道的规则而定，通常为 1-7 个工作日。
    Execution: After the review is approved, the Platform will refund the amount to your original payment account (e.g., WeChat balance, bank card) in the same way, or to your Platform account balance for future use with your consent. The refund arrival time depends on the rules of different payment channels, usually 1-7 working days.
• 系统故障处理：如因平台系统故障导致出现重复扣款、金额错误等异常情况，经核实后，平台负责纠正错误（如退还多扣款项或补足服务）。除纠正错误外，平台不承担其他额外赔偿责任。
  System Failure Handling: If duplicate deductions, incorrect amounts, or other abnormal situations occur due to Platform system failures, the Platform shall correct the error (e.g., refund overcharged amounts or supplement services) after verification. Beyond correcting the error, the Platform shall not assume any other additional compensation liability.

7. 隐私与数据 / Privacy and Data

7.1 数据保存与处理 / Data Storage and Processing

• 数据类型：为向您提供并保障服务的正常运行，平台会收集、存储和处理以下类别的数据：
  Data Types: To provide and ensure the normal operation of the services, the Platform will collect, store, and process the following types of data:
  • 账户信息：您注册时提供的身份标识信息（如邮箱地址、手机号）及账户设置。
  • 服务操作数据：您的 API 调用记录（包括调用时间、请求参数、消耗金额、IP 地址）、登录日志、设备信息等。
  • 内容数据：您为使用服务而主动上传的图片以及通过本服务 API 生成的视频内容。
• 存储与安全：上述数据将存储于平台位于中华人民共和国境内的云端服务器上。平台将采取符合行业标准的安全技术和管理措施（如加密传输、访问控制、安全审计）来保护您的数据安全，防止其遭到未经授权的访问、披露、使用、修改或损坏。
  Storage and Security: The above data will be stored on the Platform's cloud servers located within the territory of the People's Republic of China. The Platform will adopt industry-standard security technologies and management measures (e.g., encrypted transmission, access control, security audits) to protect your data security and prevent unauthorized access, disclosure, use, modification, or damage.
• 存储期限：我们仅在为实现本服务目的所必需的期限内保留您的个人信息。在您主动注销账户后，或在您的账户因长期未登录等原因被平台清理后，我们将按照法律法规要求对您的个人信息进行删除或匿名化处理。但根据相关法律法规要求，部分日志信息可能需要延长保留期限。
  Storage Period: We only retain your personal information for the period necessary to achieve the purpose of this service. After you actively cancel your account or your account is cleared by the Platform due to long-term inactivity, etc., we will delete or anonymize your personal information in accordance with legal requirements. However, some log information may need to be retained for an extended period in accordance with relevant laws and regulations.

7.2 信息调取与披露 / Retrieval and Disclosure

• 原则：平台将严格保密您的个人信息和数据，不会将其出售给第三方。
  Principle: The Platform will strictly keep your personal information and data confidential and will not sell it to third parties.
• 依法调取：您理解并同意，根据相关法律法规及国家标准，在以下情形下，平台可能会在未经您另行授权或同意的情况下，向有权机关提供您的相关数据：
  Legal Retrieval: You understand and agree that in accordance with relevant laws, regulations, and national standards, the Platform may provide your relevant data to competent authorities without your additional authorization or consent in the following circumstances:
  • 为配合司法机关、行政机关基于法定程序和要求进行的调查、取证、审查等；
  • 为遵守适用的法律法规、法律程序、强制性的政府要求或司法裁决；
  • 为应对公共安全、公共卫生重大公共利益需要，或保护您、其他用户或公众的人身财产安全免遭侵害而有必要披露的。
• 用户知情权：在法律法规允许且不危害执法活动的前提下，平台将尽力通知您有关的信息披露要求。
  User's Right to Know: To the extent permitted by law and without endangering law enforcement activities, the Platform will make every effort to notify you of relevant information disclosure requirements.

8. 未成年人保护与付款责任 / Minor Protection and Payment Liability

• 严格禁止使用：平台的服务与内容仅面向年满 18 周岁的成年人提供。我们严禁未满 18 周岁的未成年人注册账户或使用本服务。
  Strict Prohibition of Use: The Platform's services and content are only provided to adults over 18 years of age. We strictly prohibit minors under 18 years of age from registering accounts or using this service.
• 监护人的责任与承诺：若您的未成年子女或其他受您监护的被监护人，在未获得您同意的情况下使用了您的账户或通过其他方式使用本服务并产生消费，您作为法定监护人应承担由此导致的全部法律责任和经济后果，包括但不限于：
  Guardian's Responsibilities and Undertakings: If your minor child or other ward under your guardianship uses your account or this service in other ways without your consent and incurs consumption, you as the legal guardian shall bear all legal responsibilities and economic consequences arising therefrom, including but not limited to:
  • 支付已产生的所有服务费用； / Paying all generated service fees;
  • 承担因未成年人使用服务可能引发的任何第三方索赔； / Bearing any third-party claims that may arise from the minor's use of the services;
  • 赔偿因此给平台造成的任何损失。 / Compensating for any losses caused to the Platform thereby.
• 平台措施与免责：平台将通过技术手段尽合理努力识别未成年人用户，并对疑似未成年人账户采取限制或冻结措施。尽管有前述措施，若仍发生未成年人使用并消费的情况，平台一经核实，有权不予退还款项，且不承担任何由此产生的赔偿责任。所有涉及未成年人的争议，平台仅可应监护人要求提供必要的账户使用记录，实际责任由监护人自行处理。
  Platform's Measures and Disclaimers: The Platform will make reasonable efforts to identify minor users through technical means and take restrictive or freezing measures against suspected minor accounts. Despite the aforementioned measures, if a minor still uses and consumes the services, the Platform, upon verification, has the right to refuse refunds and shall not assume any compensation liability arising therefrom. For all disputes involving minors, the Platform may only provide necessary account usage records at the guardian's request, and the actual liability shall be handled by the guardian independently.

9. 修订权利 / Right to Revise

• 修订权：平台有权基于业务发展、技术更新、法律法规变化或维护交易秩序等需要，随时单方面修订本协议的任何条款。
  Right to Revise: The Platform has the right to unilaterally revise any terms of this Agreement at any time based on business development, technical updates, changes in laws and regulations, or the need to maintain transaction order.
• 通知与生效：所有修订内容将在平台官方网站（https://carryai.ai/）的显著位置（如公告栏、弹窗提示）进行公示。变更后的协议自公示载明的生效日期起生效。
  Notification and Effectiveness: All revised content will be published in a prominent position (e.g., announcement board, pop-up prompt) on the Platform's official website (https://carryai.ai/). The revised Agreement shall take effect from the effective date specified in the publication.
• 用户同意义务：您有义务定期（建议每次登录时）查阅平台的最新协议内容。若您在协议修订生效后继续使用本服务，即视为您已充分阅读、理解并接受修订后的协议，并同意受其约束。若您不同意修订后的协议，您必须立即停止使用本服务并注销账户。
  User's Obligation to Agree: You are obligated to review the latest Agreement content regularly (it is recommended to do so each time you log in). If you continue to use this service after the revised Agreement takes effect, you are deemed to have fully read, understood, and accepted the revised Agreement and agreed to be bound by it. If you do not agree to the revised Agreement, you must immediately stop using the service and cancel your account.

10. 适用法律与管辖权 / Applicable Law and Jurisdiction

• 法律适用：本协议的订立、效力、解释、履行及争议的解决，均适用中华人民共和国（为本协议之目的，不包括香港特别行政区、澳门特别行政区和台湾地区）法律。
  Applicable Law: The formation, validity, interpretation, performance, and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China (for the purpose of this Agreement, excluding the Hong Kong Special Administrative Region, Macao Special Administrative Region, and Taiwan Region).
• 争议解决：因本协议或本服务所引起或与之相关的任何争议、纠纷或索赔，双方应首先尝试通过友好协商解决。若协商不成，任何一方均有权将争议提交至平台运营主体注册地有管辖权的人民法院通过诉讼方式解决。
  Dispute Resolution: Any dispute, controversy, or claim arising out of or in connection with this Agreement or the Services shall first be resolved through friendly negotiation between the parties. If negotiation fails, either party shall have the right to submit the dispute to the people's court with jurisdiction over the place where the Platform's operating entity is registered for resolution through litigation.
• 条款可分性：如本协议中的任何条款因任何原因被有管辖权的法院认定为无效或不可执行，该条款应在最低必要范围内被限制或删除，而不影响本协议其余条款的持续有效性。
  Severability of Terms: If any term of this Agreement is deemed invalid or unenforceable by a competent court for any reason, such term shall be restricted or deleted to the minimum extent necessary without affecting the continued validity of the remaining terms of this Agreement.
